Terms of Use and Privacy Policy

Welcome to As Is Right Now (the "App"). The App lets users request real-time photos from specific geographic locations, and lets other users take and upload photos and earn community reputation points. Using the App constitutes full acceptance of the terms set out below.

PART APart A — Terms of Use

1.Acceptance of the terms

Using the App constitutes full and unreserved acceptance of these terms of use. If you do not agree to the terms, you must stop using the App immediately.

We may update these terms from time to time. Continuing to use the App after the terms have been updated constitutes acceptance of the updated terms.

2.Minimum age

Use of the App is permitted only to users aged 18 and over. By registering for the App you declare that you are 18 years of age or older.

3.How the platform works

• A "requester" can post a request for a photo from a specific geographic location, chosen from a predefined list of request topics.
• A "photographer" located near that place can take and submit a photo, and earn community reputation points.
• Every photo goes through automated processing and verification before it is passed to the requester.

4.Rules of conduct and prohibited content

The user undertakes not to use the App for any of the following:

• Photographing people inside private buildings, in bathrooms, or anywhere there is a reasonable expectation of privacy.
• Photographing minors without the explicit consent of their parents.
• Uploading fake or manipulated photos, or photos that were not taken in real time at the requested location.
• Making requests for the purpose of surveillance, harassment, or invading the privacy of a specific person.
• Uploading offensive, racist, sexual or violent content, or any other content that is contrary to law.
• Attempting to circumvent the automated verification and face-blurring mechanisms.
• Using the App while driving or during any other activity that endangers safety.
• Photographing military bases, military facilities, military vehicles, soldiers on duty, security sites, or any facility considered security-sensitive — whether marked as such or not.
• Photographing police stations, police vehicles, or officers on duty in a manner that could endanger their work or harm public safety.

5.Face-blurring mechanism

The App applies automatic blurring of faces and licence plates to every approved photo. However:

• Responsibility for protecting the privacy of the people photographed rests with the photographing user. The photographer acts solely as an independent party; there is no employer-employee, agency or partnership relationship of any kind between the photographer and the App, and the App is not responsible for any act of the photographer.
• The technology is not perfect and may fail to detect faces in difficult lighting or at unusual angles.
• People must not be photographed in compromising situations even if the automatic blurring is applied.
• Anyone who identifies a photo of themselves that was published without consent may contact us to request its removal.

6.Points and reputation system

The App operates a community points and reputation system, subject to our sole discretion:

• Points reflect activity and contribution to the community only. They are not money, cannot be converted into money or goods, and cannot be transferred between users.
• The App may change the points policy at any time, including updating point values or resetting accumulated points.
• The App may limit, suspend or cancel points accumulated by improper means.

7.Intellectual property

• The photographer retains copyright in the photos they take.
• By uploading a photo, the photographer grants the App a non-exclusive, royalty-free, worldwide licence to use the photo within the App, including displaying it to the requester.
• The App will not use photos for external advertising without explicit consent.
• Approved photos are retained on the App's servers for no longer than 90 days from the date of approval.

8.Limitation of liability

The App is provided "AS IS" without any express or implied warranty. We will not be liable for any direct, indirect, incidental or consequential damage arising from:

• Use of, or inability to use, the App.
• Content uploaded by other users.
• Technical faults, server outages, or data loss.
• The actions of other users on the platform.

9.Termination and suspension

We reserve the right to suspend or close a user account, without prior notice, in cases of:

• Breach of these terms of use.
• Suspected manipulation of the points system.
• Abusive behaviour towards other users.
• Any other activity that in our view harms the service or its users.

PART BPart B — Privacy Policy

10.Information we collect

Information you provide directly:

• Username and password (encrypted), or sign-in details from a Google account (name, email address and account identifier), or from Sign in with Apple (an Apple account identifier, and an email address which may be a private relay address provided by Apple, and a name if you choose to share it).
• Email address (for verification and identification purposes only).

Information collected automatically:

• Geographic location — collected only while the App is active and only if the user permits it. Location is used for the basic functioning of the App (finding nearby requests, verifying that a photographer is near the requested location).
• Photos taken and uploaded through the App.
• Usage data: sign-in times, times at which requests were created, and points updates.
• A device identifier used to send push notifications, device type and operating system — for operational and technical support purposes only.
• Account activity log — we keep a record of key account actions, such as deleting content, changing a password, blocking users and changing notification settings. Administrative actions performed on your account are also recorded (such as suspension, content removal, password reset and sending notifications). What is recorded is the fact that the action occurred and when — not the content of messages or text. This information is used for support, enforcement of the terms of use and responding to user enquiries, and is not passed to external parties unless required by law.

11.How we use the information

• Operating the platform service: matching requests to photographers by location, managing the points system.
• Verifying photos: processing photos to check that they are relevant to the request.
• Automatic blurring of faces and licence plates: processing photos before they are shown to the requester.
• Improving the service: anonymous statistical analysis of usage patterns.
• Communication: sending notifications about nearby requests and relevant activity.

12.Sharing information with third parties

We do not sell, trade or transfer personal information to third parties, except for:

• Image processing providers — uploaded photos may be sent to external processing services solely for content verification and face blurring. These services are subject to their own privacy policies.
• Technical service providers — storage servers and cloud infrastructure subject to confidentiality agreements.
• Law enforcement authorities — where required by law or court order.

13.Geographic location

Use of geographic location is a necessary condition for the App to function. We undertake:

• Not to store a detailed location history of users.
• Not to share real-time locations with external parties.
• The photographer's precise location is not shown to the requester — only general proximity. For clarity, a submitted photo is inherently connected to the location of the request and the time it was taken.

14.Information security

• Passwords are stored encrypted using bcrypt.
• Communication between the App and the servers is encrypted using HTTPS.
• Access to the database is restricted to the development team only.
• Photos are retained for up to 90 days from the date of approval.

15.User rights and account deletion

Subject to applicable privacy protection laws, you have the right:

• To request access to the personal information held about you.
• To request correction of incorrect information.
• To request deletion of your account and the personal information associated with it (the "right to be forgotten").
• To contact us with any question concerning your data.

16.Cookies and tracking

The mobile App does not use cookies. The server may store temporary session identifiers for user authentication only.

PART CPart C — Photography and Privacy Guidelines

17.Legality of photography

The photographer is responsible for ensuring that their photos comply with Israeli law:

• Photography in public space is permitted without explicit consent.
• Photographing into private property from public space in an intrusive manner is prohibited.
• Photographing people in private situations is prohibited even if they are close to public space.
• It is recommended to photograph scenery, buildings and public events rather than focusing on specific individuals.

18.Removal claims

• You can report a photo using the "Report photo" button in the App, or contact us directly to request removal.
• We will examine every request and act to remove the content within 48 hours of receiving it. Content of a security-related nature is removed immediately upon receipt of the report, without waiting for review.
• A photographer who uploaded infringing content may be suspended from the App.

19.Detection and prevention of prohibited requests

The App operates a mechanism to detect and prevent photo requests that breach the terms of use. This covers:

• Requests to photograph security sites, military bases, or military or police vehicles.
• Requests to document illegal acts (vandalism, arson, break-ins, prohibited trade, and any other criminal offence).
• Requests that could endanger a person, the public, or national security.

A request identified as prohibited is not passed on to photographers. The user receives an immediate notice that the request was rejected and why.

In addition, every request identified as prohibited is recorded in the system and flagged for review. A user who submits three prohibited requests is automatically suspended pending manual review, and may be permanently removed from the App.

CONSENTConsent to the terms

Use of the As Is Right Now App constitutes full acceptance of everything stated in this document. This document constitutes a binding agreement between you and the developers of the App.
